Terms & Conditions — Landowners (Hosts)

WildPass is a marketplace and software platform. You — not WildPass — grant guests permission to enter your land, set your rules, prices, and capacity, and are the merchant of record for every transaction. WildPass is not your agent, insurer, property manager, or employer.

WildPass provides NO liability insurance, property insurance, or indemnity of any kind to hosts. If a guest is injured or killed on your land, or damages your or others' property, that liability is yours to manage — not WildPass's. By listing, you accept full responsibility for the condition of your land and your legal exposure as its owner or controller.

We strongly recommend every host carry liability insurance before accepting a single booking — typically a farm/ranch liability policy, a recreational-lease policy, or a rider on an existing policy. Charging a fee for access can reduce or eliminate the protection of your state's recreational-use statute, which makes coverage more important, not less. WildPass provides an optional liability waiver you can require guests to sign at booking. It releases you from claims arising from ordinary risks of recreation on your land — except claims caused by your own gross negligence or willful misconduct, which no waiver can release. The waiver is a template, not legal advice; enforceability varies by state, and a waiver is a supplement to insurance, never a substitute for it.

You represent that you own or legally control every acre you list, that your zone maps and species information are honest, and that your listing complies with local zoning, permitting, health, and safety law. Disclose known hazards (wells, cliffs, unsafe structures, aggressive animals, active machinery or logging) in your listing or check-in notes. Keep zone maps current. Land enrolled in public-access tax programs (CFA, MFL-Open, walk-in programs) may already be committed to free public access — verify before listing those acres.

Free-access hosts provide minimal information and cannot set prices. Charging any fee requires business details, tax acknowledgment, and identity + bank verification through Stripe, who handles KYC and IRS 1099-K reporting. Firearms, ammunition, and regulated weapons may not be sold or rented through the platform under any circumstances.

Guests pay your listed price plus a 6% WildPass platform fee — you receive 100% of your listed price, less Stripe's payment-processing costs. As merchant of record you handle refunds per your stated policy and carry chargeback liability. Your earnings are taxable; see Taxes & 1099-K.

Honor confirmed bookings, respond to guests promptly, and rate honestly. Misrepresented listings, discrimination against guests in violation of law, repeated cancellations, or safety violations may result in delisting or account termination. We may update these terms; continued listing after notice is acceptance. Michigan law governs, disputes by individual arbitration except where prohibited.
